Version 2026-10-20.1 · Updated on 23 October 2026
These Partner terms of service (the “Terms”) are the agreement between Pick2Rent (“we”, “us”), based in Tunis, Tunisia, and the car-rental company that applies for or uses our services (the “Partner”, “you”). Our full legal details are available on request at hello@pick2rent.com. By applying or using the Services, you accept these Terms.

1. Definitions
- Services: the Pick2Rent platform, including the partner portal (bookings, fleet, pricing, payments and deposits, check-in and check-out, invoices, reports, team), the branded booking website, API access on the Premium Plan or as an add-on, onboarding and support.
- Renter: a customer who rents or wishes to rent a vehicle from you. Rental Contract: the contract between you and a Renter.
- Online Booking: a booking paid online through Pick2Rent. Commission: the percentage we deduct on Online Bookings, at the rate shown on your plan (Basic, Standard or Premium, the “Plan”).
- Payment Provider: a certified third-party payment provider, such as Stripe, PayPal or a local Tunisian gateway (Konnect, ClicToPay, Paymee).
- Partner Data: all data and content entered into the Services by you, your staff or your Renters. Renter Data: the personal data of Renters and additional drivers within it.
2. Acceptance and approval
The Services are for businesses only. The person who applies confirms that they can bind the company.
To apply, you complete the application form on the partner portal and provide your company details, a trade register extract, your car-rental licence and the bank account for payouts. We aim to answer within 48 hours and may accept or refuse an application.
This agreement starts when we approve your application and lasts until it is terminated under section 15. It consists of these Terms, the Plan details on the pricing page and, where we agree a custom price or custom limits with you, the written agreement, which prevails on the points it covers.
3. The Services
We are a technology provider. We give you the tools to run your rental business and, on eligible plans, a booking website under your own brand. After approval, a specialist onboards you.
Pick2Rent is not a marketplace: your vehicles are never shown next to those of other rental companies, and we never sell your data. You can export your data at any time.
We do not give legal, tax, accounting or insurance advice.
4. Accounts and security
Keep your licence, insurance and bank details accurate. You are responsible for your users and for everything done through your account. Give each user their own login, assign roles carefully and use two-factor authentication, which is available. Tell us at once at hello@pick2rent.com if you suspect unauthorised access.
5. Eligibility and compliance
You declare and guarantee that, throughout this agreement:
- you are a lawfully established business with every licence and authorisation needed to rent vehicles where you operate, including a valid car-rental licence;
- your vehicles are lawfully registered, roadworthy and insured as the law requires;
- your rental terms, prices, deposits and cancellation conditions are lawful, clear, given to Renters before they commit, and compliant with the consumer-protection, tax and data-protection rules that apply to you;
- you will honour the bookings you confirm and treat Renters fairly.
We do not inspect your vehicles or check your Renters, and our tools do not replace your own checks. Send us proof of your licence or insurance on request, and tell us promptly if either lapses.
6. Plans, free trial and fees
The Plans are described on the pricing page:
- There are three Plans: Basic, Standard and Premium. Each is a monthly or yearly subscription; the higher the Plan, the higher the limits and the lower the Commission. There is no free Plan.
- A new account starts with a free trial of the Standard Plan, with every Standard feature and no payment card. At the end of the trial you choose and pay a Plan; otherwise your account becomes read-only (you can still see and export your data, and nothing is deleted) until you choose and pay a Plan.
- If a subscription ends or an invoice stays unpaid after the grace period, the account becomes read-only in the same way and opens again when you choose a Plan and pay. While it is read-only, your website takes no new bookings and the messages to your customers are paused.
- Add-ons and packs (such as GPS tracking or an SMS pack) can be bought on top of any Plan at the price shown in the portal; they are invoiced with your subscription.
The Commission applies only to Online Bookings, at the rate shown on your Plan. Bookings taken at the counter or by phone and collected by you carry no Commission. Do not cancel, alter or re-route an Online Booking to avoid the Commission.
Subscriptions are billed in advance. Upgrades apply immediately; downgrades and cancellations take effect at the end of the paid period. Fees already paid are not refunded, except as provided in section 15 or by law.
7. Taxes, invoicing and price changes
Prices are shown without VAT. Tunisian VAT (currently 19%) and other applicable taxes are added where relevant. We invoice subscription fees and Commission; the Commission appears in your monthly statement (section 8) and may be deducted from your payouts. You are responsible for your own taxes.
We may change our prices, Commission rates or Plan features with at least 30 days’ notice by e-mail or in the portal. If you do not accept a change, you may cancel before it takes effect; otherwise it applies from the date in the notice.
8. Online payments and payouts
Our role
We are a technology provider, not a bank or a payment institution, and not a party to your Rental Contracts. Card payments are processed by Payment Providers, which are certified third parties; we never store full card numbers. By connecting a Payment Provider, you accept its terms and identity checks.
Deposits and payouts
A security deposit can be pre-authorised (held) on the Renter’s card, then released or captured, as you decide in line with your Rental Contract and the law. Online payments are paid out to your company’s bank account, with a monthly statement listing each booking and the Commission deducted.
Refunds, disputes and chargebacks
You are responsible for refunds owed to Renters under your Rental Contract. Refunds, disputes and chargebacks are tracked in the portal. You must answer disputes with the evidence requested, within the Payment Provider’s deadlines, and you bear refunds, chargebacks and related fees unless they result from our fault.
Reserves and set-off
We may delay a payout or hold back a reasonable reserve if we suspect fraud or unlawful use, if there are disputes or many chargebacks, if a Payment Provider or the law requires it, or if you owe us money. We may set off what you owe us (fees, Commission, and refunds, chargebacks or penalties we have paid or advanced) against your payouts; any balance is payable on invoice.
9. The Rental Contract
Each Rental Contract is between you and the Renter only. You set your prices, conditions, deposits, cancellation rules and insurance, and you alone are responsible for the vehicle, the Renter’s use of it, fines, damage and any claim. We are not a party to it and do not guarantee any Renter’s identity, solvency or driving record.
10. Content and intellectual property
We own the Services, including the software, design, documentation and the Pick2Rent name and logo. During this agreement, we grant you a non-exclusive, non-transferable, revocable right to use the Services for your own business. You may not copy, resell, sublicense or reverse engineer them, except as the law allows.
You keep ownership of your Partner Data. You give us a limited, non-exclusive licence to host, process, display and transmit it only to provide, secure and support the Services. You guarantee that you have the right to use this content and that it infringes no one’s rights. We may use technical usage data (not Renter Data) to operate and improve the Services, and will not use your name or logo as a reference without your permission.
11. Data protection
Roles
For Renter Data, you are the controller and Pick2Rent is the processor. For the data of your staff, billing contacts and applicants, Pick2Rent is the controller (see our Privacy policy). As controller, you must have a lawful basis, inform Renters, collect only the data you need, make any declaration or obtain any authorisation required by law (including from the Tunisian data protection authority, the INPDP) and handle Renters’ requests.
We host, store, display and transmit Renter Data (identity and contact details, driving licence and ID documents, booking, payment and deposit references, never full card numbers) of Renters and additional drivers only to provide the Services, for the term of this agreement and the export window below.
Our obligations as processor
- We process Renter Data only on your documented instructions (these Terms, your use of the Services and your written requests) and tell you if we believe an instruction breaks the law.
- Our staff with access to Renter Data are bound by confidentiality.
- We apply appropriate technical and organisational measures: encrypted connections (TLS), encrypted storage of bank details, role-based access, available two-factor authentication, an audit log, backups, and private storage with signed links for documents.
- We notify you without undue delay after becoming aware of a personal data breach affecting Renter Data, with the information you need to meet your obligations.
- We help you answer Renters’ requests (access, correction, erasure and others) and meet your obligations on security and impact assessments. If a Renter contacts us directly, we forward the request to you.
- We provide the information needed to show our compliance and allow reasonable audits, with notice and subject to confidentiality.
Sub-processors and transfers
You give us a general authorisation to use sub-processors, currently in these categories: cloud hosting, CDN and file storage (Bunny.net), transactional e-mail delivery (Brevo) and payment providers. We bind each of them by contract to equivalent obligations and remain responsible for them. We give you the list on request and tell you in advance of any change; you may object on reasonable data protection grounds and, if we cannot resolve the objection, end this agreement. Payment Providers that you connect act under their own terms, in some cases as independent controllers. If data is processed outside Tunisia, we ensure appropriate safeguards and help you obtain any authorisation required by law.
Return and deletion
You can export your data at any time. When this agreement ends, you have 30 days to export your Partner Data. After that, we delete or anonymise it, including Renter Data, unless the law requires us to keep it; backups are overwritten in the normal cycle. For personal data, this section prevails over any conflicting provision.
12. Confidentiality
Each party keeps the other’s non-public business, technical, pricing and financial information confidential and uses it only for this agreement. This does not apply to information that is public through no fault of the recipient, already known or independently developed, or required to be disclosed by law. It lasts during the agreement and for 3 years after.
13. Support and availability
Our support team is available Monday to Friday, 9:00 to 18:00 (Tunis time), at hello@pick2rent.com, and answers within one business day in French, Arabic and English. Support is for Partners; you support your own Renters.
We make reasonable efforts to keep the Services available and secure, but we do not guarantee a specific uptime percentage. We announce planned maintenance in advance where possible.
14. Acceptable use
You must not:
- use the Services for anything unlawful, fraudulent or misleading, including money laundering, payments that are not genuine vehicle rentals, or false information about vehicles, prices or conditions;
- upload unlawful or infringing content, or malware;
- access other accounts or our systems without authorisation, test their security without our written permission, or disrupt the Services, including with excessive automated requests;
- collect Renter Data you do not need, or resell the Services without our written agreement.
15. Suspension and termination
Termination
This agreement has no fixed term. You may close your account at any time by writing to hello@pick2rent.com; for a paid Plan, closure takes effect at the end of the paid period. Either party may end the agreement with 30 days’ written notice (if we do so without any breach on your part, we refund prepaid fees for the unused period), or immediately if the other commits a serious breach and does not remedy it within 15 days of notice, or becomes insolvent. We may also end it immediately for fraud, unlawful activity, loss of your licence or insurance, or an order of an authority.
Suspension
We may suspend or limit access, in whole or in part, if the security of the Services is at risk, if we suspect fraud or unlawful use, if you breach these Terms or do not pay an amount due after a reminder, if your licence or insurance lapses, or if an authority or Payment Provider requires it. We tell you why, beforehand where possible, and restore access once the cause is resolved.
Effects
When the agreement ends, your access and your booking website stop, and you have 30 days to export your data (section 11). Amounts due remain payable, payouts due are paid net of what you owe, and provisions that by nature survive continue to apply.
16. Liability
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, wilful misconduct, gross negligence, death or personal injury. Subject to that:
- the Services are provided “as is”: we do not warrant that they will be uninterrupted or error-free, or that you will receive any bookings or revenue;
- neither party is liable for indirect or consequential damage, such as loss of profit, revenue, goodwill or data;
- our total liability for all claims arising from this agreement is limited to the fees (subscriptions and Commission) you paid us in the 12 months before the event giving rise to the claim.
You are solely responsible for your rental activity: vehicles, Rental Contracts, Renters, fines, damage and compliance with the law. You indemnify us against third-party claims (for example by Renters or authorities) and the related losses and reasonable costs, to the extent they arise from your acts or omissions, your breach of these Terms or the law, your Partner Data or your Rental Contracts. We will tell you promptly of any claim, let you control the defence (without any settlement that binds us unless we agree) and cooperate reasonably.
17. Force majeure
Neither party is liable for failing or delaying to perform its obligations (other than paying amounts due) because of an event beyond its reasonable control, such as natural disaster, epidemic, war, strike, government decision, power or internet failure, cyber-attack despite reasonable protection, or failure of a third-party provider. The affected party informs the other promptly and limits the effects. If the event lasts more than 60 days, either party may end the agreement by written notice.
18. Changes to these Terms
We may update these Terms with at least 30 days’ notice by e-mail or in the portal. If you do not accept the change, you may end the agreement before it takes effect; if you keep using the Services afterwards, you accept it. A change required by law or by an urgent security need may apply sooner.
19. Governing law and disputes
These Terms are governed by Tunisian law. If a dispute arises, the parties first try to settle it amicably: write to hello@pick2rent.com and we will discuss it with you within 30 days. Failing an amicable settlement, the competent courts of Tunis have jurisdiction.
20. Language
These Terms are available in English, French and Arabic. If the versions differ, the French version prevails.
21. General provisions
- Entire agreement. These Terms, with the Plan details and any written quote, are the entire agreement on the Services.
- Assignment. You may not transfer this agreement without our written consent. We may transfer it to a successor to our business, and will tell you.
- Severability and waiver. If a provision is invalid, the rest remains in force. Not enforcing a right is not a waiver.
- Independence. Despite the name “Partner”, nothing here creates a partnership or agency.
- Notices and evidence. We send notices to your account e-mail address or in the portal; you send them to hello@pick2rent.com. Electronic records, including acceptance records and logs, can be used as evidence.
22. Contact
For any question about these Terms, write to hello@pick2rent.com or use the contact form.
